Planning Policy
The Copeland Local Plan 2001-2016
The plan has been through a number of stages during preparation with various sections having been amended or replaced to accommodate objections.
All these changes have yet to be consolidated into a single volume of text and a Proposals Map. This work will be completed during the next few weeks but until then, the Adopted Plan exists as a series of documents, which should be approached as follows:
2nd Deposit Version
This is the definitive pre-Inquiry text on which all the subsequent changes and modifications have been based. Use this document to establish where your area or subject of interest is dealt with.

IC001 - Managing The Housing Supply
Revises all of sections 4.2 and 4.3 in the plan and is the version of text on which the Inspector based his recommendations.

Proposals Map
Consists of coloured maps from the 1st Deposit Version with subsequent changes incorporated in black and white maps with the 2nd Deposit.

Proposed Modifications
This document which sets out all the Modifications to the 2nd Deposit text, which the Council has undertaken in accordance with the Inquiry Inspector's recommendations. Any changes to the Proposals Map are incorporated in an additional set of black and white maps alongside these Modifications.
- View the Proposed Modifications
(NB. The modifications are based on the 2nd Deposit text and running order except for Sections 4.2 and 4.3 of the Housing Chapter where an Inquiry change, Ref. IC001, is the base text.
Also that reference numbers in the Proposed Modifications are based on the Inspector's Report but local plan paragraph and policy numbers are fairly obvious within this approach.)
Copies of the documents which make up the Adopted Plan are available for inspection at the following places during normal office hours:
- The Copeland Centre, Catherine Street, Whitehaven, Cumbria CA28 7SJ
and - The Millom Council Centre, St. Georges Road, Millom, Cumbria LA18 4DD
The plan came into operation on 6th June 2006. A person aggrieved by the proposals who desires to question their validity on the ground that they are not within the powers conferred by Part II of the Town and Country Planning Act 1990 or that any requirement of that Act or any regulation made under it has not been complied with in relation to the adoption of the proposals, may, within 6 weeks from 8th June 2006, make an application to the High Court under section 287 of the 1990 Act.
The Planning and Compulsory Purchase Act 2004 has introduced a series of significant changes to the development planning system but as the Council was at an advanced stage with its replacement plan, the process continued to adoption under the Town and Country Planning Act 1990, the Planning and Compensation Act 1991 and the Town and Country Planning (Development Plan) (England) Regulations 1999.
Now adopted, the policies and proposals which it contains will be ‘saved' for an initial period of 3 years unless they are replaced beforehand.
