Local Plan Proposed Modifications
The Council received the Inquiry Inspector's Report on 20th February. It has considered all his recommendations and on 29th March formally resolved to modify the Plan.
These Proposed Modifications are now published for inspection by interested parties who can make formal representation (either in support or objecting) before 19th May 2006. However, such representations can only relate to the Modifications, or to the fact that the Council has not accepted a recommendation for modification made by the Inspector.
At this stage objections cannot relate to the contents of the Deposit Versions of the Plan.
The documents which are placed on deposit for inspection are available via links below, or they can be inspected at the Council's Whitehaven and Millom offices during normal office hours.

There is a special form to use for making a representation which is available from the Council's offices or which can be submitted on-line below. A separate form should be completed for each objection or expression of support.
The Inspector's examined each of the unresolved objections to the 1st and 2nd Deposit Versions of the Plan. These are in Plan order, with each recommendation given an 'R' number reference, e.g. R4.56.1 where 4 related to Chapter 4 in the Plan (Housing), 56 is the 56th particular issue covered by the Inspector under Housing and 1 is the first of two recommendations within this heading.
The Inspector has grouped his recommendations and explains his approach to each section at the outset. He uses paragraph numbers for the grouping and there is a cross-reference in his Appendix G at the back of the Report between objectors, objections and the paragraph numbers for those who wish to trace through how their objection was dealt with.
The Council deals with each of the Inspector's recommendations in the order of his 'R' numbers, indicating for each whether there is a Proposed Modification and what form any Proposed Modification takes.
Additional explanations and cross-referencing are set out in italics. Reference is also made to the Pre-Inquiry Changes and Inquiry Changes which the Council provided to the Inquiry as suggested options for meeting some of the outstanding objections.
In his report the Inspector has indicated where these could be used as appropriate modifications with 'PC' numbers, referring to 'Pre-Inquiry Changes' and 'IC' numbers, referring to 'Inquiry Changes'.
Where the Council is not accepting the Inspector's recommendation for modification, the words 'No Modification' are indicated in bold type.

- R5.23.1 - Whitehaven Town Centre Boundary
- R5.23.3 - Whitehaven Primary Shopping Area
- R9.5.1 - Wind Energy
The Council's reasons for not accepting the Inspector's recommendation in each case is set out in the Proposed Modifications.
Where a Modification requires an alteration to be made to the Proposals Map, e.g. a new land allocation or a change to a settlement boundary, a separate map has been prepared in PDF format [see links below]
There are links below to schedules setting out the changes. There is a separate link to IC001 which incorporates the text upon which the Inspector bases his recommendations on Sections 4.2 and 4.3 of the Housing Chapter (ref R4.3.1). This was compiled as a result of the Housing Roundtable Session at the Inquiry.
The Proposed Modifications are available for comment until 12 noon on the 19th May. The Council will consider all representations received and decide whether it is necessary to hold a further inquiry and /or make further modifications to the Plan.
If no objections are are received, it is the Council's intention to adopt the Plan as modified in accordance with the Proposed Modifications after 28 days (ie. 16th June).
