Copeland Local Plan Process

The process of preparing a new plan to replace The Copeland Local Plan 2001 began with the publication of an Issues Report for public consultation in November 2001. The Report and a Summary of Responses can be accessed via the links from this page.

Taking into consideration the responses to the Issues Report, the Council then published the Copeland Local Plan 2001-2016 1st Deposit Version on 12th February 2004. The deposit period ran to 26th March 2004, during which time the Council received over 1100 objections and expressions of support.

The Council examined each representation and where appropriate made changes to the 1st Deposit Version. These changes were published as the 2nd Deposit Version in April 2005. A further 500 or so objections were submitted against the 2nd Deposit Version changes.

All unresolved objections to the 1st Deposit Version and the 2nd Deposit Version objections were considered by an independent Inspector at a Public Inquiry in September/October 2005. He then submitted a report with recommendations for further changes and the Council proposed a number of Modifications to the Plan. These were placed on formal deposit between 6th April and 19th May 2006. 131 representations were received which were assessed. On the 6th June 2006, the Council formally adopted proposals for the Replacement Copeland Local Plan.

The adopted plan will form part of the development plan for the area of Copeland Borough outside the Lake District National Park. The development plan forms the basis of decisions on land use planning affecting that area.

The plan came into operation on 6th June 2006. A person aggrieved by the proposals who desires to question their validity on the ground that they are not within the powers conferred by Part II of the Town and Country Planning Act 1990 or that any requirement of that Act or any regulation made under it has not been complied with in relation to the adoption of the proposals, may, within 6 weeks from 8th June 2006, make an application to the High Court under section 287 of the 1990 Act.
