The Planning and Compulsory Purchase Act 2004 introduces many changes to the planning regime operating in England and Wales.
Most of these in the first instance will affect the Development Plan-making process – the work which in Copeland has previously been delivered under the “Local Plans” banner, will be replaced by the “Local Development Framework”. The Act’s reforms are intended to make the preparation of development plans and other non-statutory documents quicker and more flexible, with increased community involvement. The new system intends to widen the ambit of planning from focusing on the control of land use to reflect a wider, more inclusive and spatial approach. The new system seeks to facilitate earlier and more in depth public consultation.

Local Development Scheme
The Local Development Scheme (LDS) sets out the documents that will be produced to form the Local Development Framework (LDF) for Copeland (excluding the area within the National Park) over the next three years. It provides the starting point for the local community to find out what the current planning policies are for the area and sets out the programme for the preparation of Local Development Documents (LDDs) to replace existing planning policies over the next three years.

Annual Monitoring Report
The Annual Monitoring Report (AMR) is required to track the impact of policies and measure how far aims are being achieved and whether they are still relevant. It provides the opportunity to identify whether changes are necessary to individual documents or to the Framework as a whole.

Strategic Flood Risk Assessment (SFRA)
A significant proportion of the urban areas within Copeland are situated in close proximity to the coast and the large rivers of the Borough, and these areas are consequently at risk of coastal and fluvial flooding. However, these are not the only flood risks. There are many locations that are threatened by flooding from the numerous small watercourses that are features of the upland and rural nature of Copeland, and from overloaded drainage and sewage systems.

Statement of Community Involvement
The Council is required to produce a Statement of Community Involvement as part of the new Planning system. The Statement of Community Involvement aims to set down how and when the Council will involve the local community in the planning process. The planning system affects everyone; policies and plans help the Council to determine which planning applications to approve or refuse. Therefore it is important that all sectors of the community are involved in the process.

Supplementary Planning Documents
Copeland Borough Council are working in partnership with Cumbria County Council, the Lake District National Park Authority and other Cumbrian District and Borough Councils to produce two county-wide Supplementary Planning Documents.
These will provide guidance to help developers put together development proposals. The first guidance document will cover wind energy development, and the second will cover landscape character. They will support the policies and proposals of the emerging Local Development Frameworks and be adopted by each local planning authority.
Pow Beck Development Brief Supplementary Planning Document
Copeland Borough Council has adopted a Pow Beck Valley Development Brief and Sustainability Appraisal Report.
The SPD refers to the Pow Beck Valley in Whitehaven. The document has been produced to assist the regeneration of this area. The SPD seeks to inform developers and other interested parties of the constraints and opportunities presented by the Pow Beck Valley area, and indicate the type of development expected by the Council.
Cumbria Wind Energy Supplementary Planning Document (SPD)
Copeland Borough Council are working in partnership with other Cumbrian Local Authorities to produce two county-wide Supplementary Planning Documents. These will provide guidance to help developers put together development proposals. The first guidance document will cover wind energy development, the documents will be available to download by following the link below from Monday 30 October 2006.
